Who Authorizes Charter Schools?

An application for a charter school has to be submitted to the New Jersey Department of Education. The application must be submitted according to the deadlines established by the department.

The local board of education may review the application and forward a recommendation to the commissioner within 60 days. The commissioner has final authority to approve or reject a charter application.

If the commissioner rejects the application the local board of education or the charter school applicant can appeal to the State Board of Education, which has to make a decision within 30 days. If the state board does not take action the decision of the commissioner is final.
